Newby question re: extended warranty after totaling a legacy

I am new to this site and I am posting this on behalf of my grandparents. They owned a 2002 legacy and my grandmother had a head-on collision 3 weeks ago and totaled the car. She was fairly injured and slammed her head into the steering wheel. The air bag never went off.

 

2 Questions:

 

1. Is anyone aware of any problems with the airbags in the 2002 legacy that could account for why it did not go off?

 

2. My grandparents had a long extended warranty, which they obviously will not need since the car was totaled. Any advice on how to recoup the cost of the extended warranty?

This may be a liability issue and you might want to contact a lawyer that handles such cases. If the airbag failed to deploy because a known problem you may have a case. I have not heard of any issuses with this though. Checking for TSB's about this may help.

 

With the extended warranty you should be able to contact the company who provided it and tell them you want to cancel the remainder of the policy. They will prorate the remainder of the contract for a refund. You should be able to apply the money towards another contract for a replacement vehicle also. If the contract was through the dealer you may want to just get the refund and start another contract through your own insurance company. It is usually less expensive to do it that way.

check out the case "McFerson v. Buick". it's kinda the same issue. it's about a buick wheel that fell apart during travel, Buick was held liable.
