now thats its getting in the 40s and 30s.  sometimeswhen it goes to shift  into second itll go back to first then back to second.

Then yesterday while in any gear even reverse the converter would lock up with the trottle input over 1/4 throttle. That shouldn't happen because it was 35 degrees outside, vehicle speed was 5 mph,and i wasn't in 4 gear. any help thanks.

How old is the fluid?

 

These cars shift funny in the cold anyway, but it sounds like its flare shifting. Old fluid can cause issues like this. The bad thing is when you start having problems like this, the trans probably won't last much longer, especially if you drive the car hard.
