I have a 96 Legacy 2.5L GT. At speeds above 80 MPH the transmission slips out of 4th gear. Is there anything I can do?

I just checked my oil, which I had changed 1500 miles before. It was below the Low Level. Could this have anything to do with it? And why does my Legacy suck down so much oil?

Does it downshift to third?

No it doesnt. It will get to about 4500 RPMs slip and then a few seconds later it will go back in and slip out again.
