i found a 95 lego ej22 5 speed which is stuck in 3rd gear. is this new trans time or maybe just a shifter issue?

Sounds like limp mode. Try to find a way to pull trans DTCs? Any CEL codes?

In my experience - that's new (used) transmission time. The EJ 5 speed's aren't all that reliable given a mild amount of abuse - if it's been abused to the point that it's stuck in a gear - it's very likely toast inside. Drain the gear oil and see what you get. It will probably be full of metal chunks and filings.
