Air Filter Question

I have a 1999 Legacy Wagon with 2.2 engine that I purchased a few months back. It has 2 air filters-(California emissions engine) one on the fender wall and one on engine wall. In servicing I noticed that the filter at the engine wall was missing. I am currently getting 31-32 mpg on the road. My question-Do I need to replace both filters or will the one on the fender wall suffice?

i beleive the air filter on the firewall is just a cabin filter and has no effects on the cars performance

I thought the second one was on the airbox someplace under the dash.

Don't have to worry about passing inspection-not required where I reside.

For a couple years they had a filter box by the firewall AND one behind the headlight (both for engine air, not cabin air). Only one filter is needed, I'd personally put it in the one by the headlight. Putting in both filters will increase the filtering of the air, but will add twice the restriction to the airflow, and really isn't necessary...in just about every production car the air just has one filter to pass through (in series...not talking about two paralell filters). Just leave the box by the firewall closed and empty...it's more of a pain to change a filter in that location anyways.
