So the story, i was in the left lane, getting onto I-90 West, from I-95 South, was passing a good ol' 92 Toyota Corrola, and i noticed they were inching closer and closer, so i faded left... until i ran out of highway, and poped the left side of the car up on the curb of the highway.. kept going, BANG, they slacked into the rear end of my car... i managed to keep mine straight, they managed to pull off a spectacular 180, and slam the front of their car into the curb on the other side of the highway... All said and done, noone was hurt besides my baby... and the toyota (their front drivers side rim got all sorts of bashed up). Massachusetts is a "no-fault" state, so where blame is placed probably won't affect the outcome of the settlement; however, it could play a part in determining whether Andy's or the other driver's rate goes up. I hope everyone is well, but in addition to the horn, how about the brakes or acceleration pedal? It sounds like there was time to take some evasive action, but maybe not. No offense to those who live and drive there, but this is a prime example of what I call a Mass-hole. In general one needs to drive defensively to avoid accidents, but in Mass it seems to apply double. The last time I was near Boston itself I had issues with people driving in 5 o'clock traffic on the shoulder. I was in a big van towing a car on a trailer and almost wipe someone out moving over onto an exit ramp because someone decided to pass me on the shoulder..... Anyhow, this really sucks. My personal experiance is that it's nearly impossible to keep a brand new car from getting hurt by some misfortune. My '05 was hit by a rogue shopping cart in a mall parking lot 2 months after I got it. The sad part was it happened while I was driving through it, not parked. My STi was rear-ended 30 days after coming off the first shipment from Japan. It sucks big time. There's even a mass-hole bumper sticker out there. It's worse when a bit of weather shows up, you really see who can't drive. A couple of weeks ago we had a State Trooper killed in a head on due to a lady reaching down to grab something and swerved into the cops lane.She got 6 months for careless driving resulting in death(pled no contest).The idiots are everywhere,they feel it is there right to drive and that it is easy as sleeping. Sorry. Wow... that's REAL bad. I dropped the car off at the body shop today, no outlook on time (should just be 2 peices of plastic, and if i'm lucky a new wheel ) As for the brakes/accelerator, i was using the skinny pedal, and fading left, but they were coming at me a little to fast to get out of their way (hence the hitting me... ). I actually had the pedal mashed into the floor, but the turbo does take a second to spool up , and i could have been in a lower gear i suppose, but then again, i didn't know i was going to need that extra go-juice :-\ inscurance company is taking care of stuff, suprisingly it hasn't been complete brain surgery to get stuff taken care of. Oh well, it's just always a pain to get out of work, and drop off the car, and all of that crap, bllahhh.... My wife got backed into by an Indian lady who refused to give up her license details etc in fear of insurance claims etc. Anyway, being THE socialist craaphole of USA, we are a magnet for dypshyt drivers here. Even if not, if you were in the left lane and you hit the curb on the left side of your car, just WHAT lane change were you supposedly executing? Go back and take pics of the wreck site so you can diagram the accident and take it in front of a judge. You can't hire a lawyer to fight a $100.00 ticket, But I for one wouldn't just take it from some dumb cop ... even in Massatwo***************s. I'm working on gathering evidence right now, i did take pics of my, and the other car at the scence of the accident, what i SHOULD have done is look for skid-marks, because if their tiremarks started in my lane, then it was obviously their fault. I'm going to go check it out and see if the marks are still there, if then are, i'll try to get a pic somehow. The citation states that i merged right into their lane, where i didn't change lanes at al!! I fully plan on fighting this, i just need some legal backing (not a lawyer) but a stronger foothold than "I didn't do that" Link to comment Share on other sites More sharing options...
